Terms of Use — FORMAT

These Terms of Use ("Terms") govern your use of the FORMAT mobile application and the website at playformat.app (together, the "Service"), operated by FORMAT ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) to create an account.
You must provide accurate information when you sign up and keep it current.
You are responsible for the security of your account credentials.

2. Your account

One account per person. Don't impersonate someone else.
You can delete your account at any time inside the app (Profile → Delete Account).
We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraud, abuse, or illegal activity.

3. Acceptable use

You agree not to:

Use the Service for any unlawful purpose or in any way that violates applicable law.
Harass, threaten, or harm other users.
Send spam, malware, or attempt to compromise the Service.
Reverse-engineer, decompile, or attempt to extract source code from the app, except where allowed by law.
Use automated scripts to scrape or hammer our servers.
Resell, sublicense, or commercially exploit the Service or its content without our written permission.
Misrepresent another user's identity in a round or invite.

4. FORMAT Pro (paid features)

What you get

FORMAT Pro is a one-time purchase that unlocks Pro-exclusive formats, payout calculators, advanced filters, unlimited favorites, and all future Pro features for the lifetime of the Service.

Pricing

Web (Stripe): $9.99 USD one-time, charged immediately.
iOS (Apple In-App Purchase): $9.99 USD one-time, charged through your Apple ID.

Refunds

Web purchases: Contact us at support@playformat.app within 14 days of purchase for a refund. We'll process refunds for any reason within that window.
iOS purchases: Refunds are handled by Apple. Request a refund via your iPhone Settings → Apple ID → Subscriptions / Purchase History → Report a Problem, or at reportaproblem.apple.com. We do not control Apple's refund decisions.
If a refund is granted, your Pro access will be revoked.

Cross-platform access

Whichever platform you purchase Pro on, your Pro access is tied to your FORMAT account and works on every platform you sign in to with that account.

5. Rounds, side bets, and wagers

FORMAT helps you discover formats and invite friends to play golf rounds. FORMAT does not facilitate, process, hold, or settle any wagers between players. Wagers and side bets are arrangements between you and the other players in your round, settled directly between you.

You are solely responsible for any money or value exchanged with other players outside of the Service.
You are responsible for ensuring that any wagering you do complies with the laws of your jurisdiction.
The Service is intended for friendly, social use among people who know each other.

6. User content

You retain ownership of the content you create (your name, the rounds you create, side bet selections).
By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display your content as needed to provide the Service to you and to the people you invite.
You are responsible for the content you post. Don't post anything you don't have the right to share.

7. Our content

The format library, rules text, design, code, branding, and other materials we provide through the Service are owned by FORMAT or licensed to us. You may use them only as part of using the Service. You may not copy, redistribute, or build derivative products from them without our written permission.

8. Third-party services

The Service uses third-party services (Stripe, Apple, Google Firebase, Meta SDK, Vercel, Upstash). Your use of these services is also governed by their respective terms. We are not responsible for the practices of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMAT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

11. Termination

You can stop using the Service at any time and delete your account in-app. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use harms others or the Service. On termination, sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will survive.

12. Apple-specific terms (iOS only)

If you downloaded the iOS app from the Apple App Store, the following also apply:

These Terms are between you and FORMAT only, not with Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). Apple has no other warranty obligation. Any other claims, losses, liabilities, damages, costs, or expenses attributable to non-conformity are FORMAT's responsibility.
Product liability claims, third-party intellectual property claims, and consumer-protection claims related to the app are FORMAT's responsibility, not Apple's.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law and disputes

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement. You waive any right to a jury trial and to participate in a class action.If you live in the EEA, UK, or other jurisdictions where pre-dispute arbitration is unenforceable for consumers, this section does not apply to you and disputes may be brought in your local courts.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated through an in-app notice or email. Continued use of the Service after changes take effect means you accept the updated Terms.
